Legal geek here (and white woman with a big crush on a beautiful Chinese man here in the U.S.) I’m following this case with interest. I read the bulk of the psychology expert’s report last night. To my understanding, and as I’m sure your attorney has explained, summary judgment is only granted if (a) there are no material factual disputes; and (b) there is law to support the position of the movant – in this case, the defendant university. I’m not an attorney; I’m a court reporter, and even attorneys can only guess at whether a Court will sustain a motion for summary judgment. So no legal advice being given here, obviously – lol. But for what it’s worth, I see an awful lot of these motions denied, because everything has to be pretty cut and dried in order for them to be sustained. So I’m keeping my fingers crossed for you. Do you have a court date yet for the motion?
