The people at My New Chinese Love asked me to pass this on — they’re running a Valentine’s day giveaway going on now until February 12, 2012. To enter, all you have to do is submit a photo about what you love most about China, and give it a creative caption. The winner receives a beautiful bouquet of flowers.

  1. That giveaway sounds interesting except that the rules stipulate that :
    “All entries become the property of My-New-Chinese-Love.com.”
    Which means they will own the photos sent to them and be able to use them as they wish… If you send a photo of yourself and your loved one don’t be surprised to find it on their website later.
    So it’s a no go for me.

      @Woods, I totally understand your disinterest — I’m sure a lot of people may feel the same way. I hope My New Chinese Love is reading your comment, as maybe they didn’t realize how these rules might discourage participation.

  2. “All entries become the property of…..” This is tricky. Entries become the property of, but there is still the question of copyright. Does ownership of a thing confer copyright to the thing on the owner? Does this automatically follow? If I own a book, do I own the copyright to it? Of course, it is better not to participate if one does not want one’s photo to be used.

  3. Further to my comment. In the case where the owner of a thing does not also own its copyright, then generally he will still need the consent of the copyright owner to use it. But in the case of a contest as here, it would be awkward if the copyright owner does not give his consent for his photo to be used, so there may be an implied consent to use here. Still, the implied consent to use must be confined only to the specific blog and to the specific purpose to which the contest relates. To me, law should be a common sensible thing. Otherwise it is an ass. But stranger things do happen in the murky world of laws. And different countries may have different laws applicable. And I am not responsible for any asses or differences. Still, like I said earlier, it is better not participate if you don’t want your photo to be used because this defeats the very matrix/logic/substratum/purpose or whatever have you of the contest.
